Navigating The Probate Process

Probate is a court supervised mechanism to transfer your estate to your beneficiaries. The assets of a trust are transferred to the beneficiaries of the trust, similar to a probate, through a Trust Administration which is NOT court supervised. The probate process is complex and many families struggle with managing all aspects of their loved one’s estate. That’s where we can help.

At Koestner & Shahon, in Whittier, we assist individuals and families with probate and trust administration issues in California. We understand probate law and how it will impact the process of closing out or managing an estate.

The Probate Process And How We Can Help

Our lawyers have more than 40 years of combined legal experience handling complex probate matters. We will guide you through the entire probate process, whether you go through intestate (dying without a will) or through the process of probating a will.

We assist with all matters involving the probate process, including:

  • Determining the validity of a Will
  • Marshalling the assets — what are the estate assets and obligations?
  • Obtaining Letters of Administration
  • Selling Real Property
  • Distribution of Assets

There are a number of assets that do not pass by Will such as life insurance proceeds, bank accounts held in joint title, or funds held in a payable-on-death bank account, to name a few. We will assist the Executor, named in the Will, or the Personal Representative, appointed by the Court, to ensure the estate is distributed according to the decedent’s wishes.

Dying Without A Will

The Probate process can seem complicated. If your family member dies without a Will, the estate will still be probated in a process known as “intestate.” Any estate property will be distributed to the decedent’s heirs at law under the Statutory laws of the State of California.
